These General Terms and Conditions of Sale aim to define the terms and conditions for distance selling between BE MAAD and the user, including ordering, payment, delivery, returns, refunds, and exchanges.
Any order placed on the website www.bemaad.com implies the user’s irrevocable acceptance of these General Terms and Conditions of Sale. Any user who does not accept these terms should not make a purchase on the website.
The user who accepts the General Terms and Conditions of Sale declares that they are of legal age, have full legal capacity, and are not under guardianship or curatorship. The product offers, services, and terms regarding delivery, payment, returns, and refunds apply to orders placed by users in mainland France, overseas territories, and European Union member states, subject to product availability and for deliveries to these same geographic areas. If a product becomes unavailable after the user has placed an order, BE MAAD commits to informing the user as soon as possible.
The offers presented on the website www.bemaad.com are valid as long as the products appear in the electronic catalog and are in stock, except for offers with specified durations. If an offer has specific validity conditions, such conditions will be indicated on the BE MAAD website in the offer details.
Promotional offers cannot be combined and are limited to one use per person. It is not possible to use a promotional offer if payment is made using credit from a return.
Promotional codes cannot be combined with each other, nor can they be combined with other promotional offers.
The essential characteristics of the products are detailed on www.bemaad.com on each product page. However, the images and colors of the products displayed on www.bemaad.com may not match the actual colors due to the effects of the Internet browser and screen used.
The products are made from natural stones, making each piece of jewelry unique. The images and colors shown on the website may differ from the product received by the customer.
Article V – Order
5.1. Acceptance
The offer is deemed accepted and validated by the user upon confirmation of the order.
5.2. Order Confirmation
The user must complete several steps prior to concluding the sales contract:
- Fill their virtual shopping cart
- Specify the quantities and/or versions of the product they wish to receive
- Select a payment method
- Provide the information related to the selected payment method
- Select a delivery method
- Provide the information related to the delivery method for the order
The user has the option to review the details of their order and its price in Euros, including all taxes, before confirming the order by clicking the "Confirm Order" button.
The confirmation of the order constitutes an irrevocable acceptance that can only be challenged within the limits provided by these General Terms and Conditions of Sale. It automatically implies acceptance of the General Terms and Conditions of Sale by the user and finalizes the sales contract.
Once the order is confirmed by the user, BE MAAD commits to sending an email to the user acknowledging receipt of their order and payment as soon as possible.

5.3. Order Validation
BE MAAD reserves the right to refuse any order for legitimate reasons, particularly if the quantities of products ordered are abnormally high for a consumer or if payment authorization could not be obtained.
As part of its policy to combat fraud and identity theft, BE MAAD may request a photocopy of an identity document from the user. Pending receipt of this document, the order will be marked as "pending validation." The requested document must be provided by the user within 10 days to ensure prompt processing of the order.
BE MAAD reserves the right to cancel any order from a customer with whom there is an ongoing dispute related to payment for a previous order.
5.4. Order Modification
No modifications to an order are possible after it has been confirmed.
5.5. Unavailability of Ordered Product or Service
If the product and/or service ordered by the user is unavailable, BE MAAD commits to informing the user as soon as possible and offering an equivalent product and/or service of similar quality and price.
If the product and/or service is unavailable and there is disagreement between the parties, the user will be refunded the amount they paid at the time of order confirmation within thirty business days from the actual payment date.
Article VI - Price
In accordance with Article L.113-13 of the Consumer Code, the prices for products sold by BE MAAD and displayed on the website www.bemaad.com are indicated in Euros, including all taxes.
These prices do not include the flat-rate contribution to transportation costs, which cover packaging, parcel preparation, and delivery according to the prevailing rates. They take into account the applicable VAT at the time the user places the order. Any change in the VAT rate may be reflected in the price of the items for sale on the website www.bemaad.com, and the user can be informed upon simple request by email or postal mail.
BE MAAD reserves the right to modify or adjust its prices at any time; however, in the event of a price change, the rates charged to the user will be those indicated at the time the order is placed. The total amount due by the consumer is shown on the order confirmation page.
In case of a promotional price, the seller agrees to apply the previously indicated promotional price to any order that meets the promotion conditions during the entire duration of the promotion.
Payments can be made via PayPal or by credit card through the Stripe payment system. Payment in 3 installments with no fees is also available via the Alma platform for orders over €100 placed in France only.
If the customer wishes to pay for their order in three installments with no fees, they accept the general and specific terms of Alma. The customer agrees to ensure that funds are available for each installment.
Article VII – Contract
7.1. Conclusion of the Contract
The contract is formed when the user confirms their order by clicking on the "Confirm Order" button.
The confirmation click constitutes an electronic signature and holds the same value as a handwritten signature between the two parties.
7.2. Archiving and Proof
In accordance with Article 1348 of the Civil Code, the archiving of communications between the parties, order forms, and invoices is carried out on a reliable and durable medium to constitute a faithful and lasting copy of the original.
These communications, order forms, and invoices may be used as proof of the contract.
It is advised that the user retains at least one copy in electronic and/or paper format of their order form, as well as the email acknowledging receipt of their order confirmation sent by BE MAAD.
Article VIII – Returns, Refunds, and Credit Vouchers
8.1. Right of Withdrawal
From the receipt of the products, the user has a withdrawal period of fourteen (14) days to return the delivered products without having to justify the reason, nor pay any penalty, except for the return shipping fees, to the following address:

When exercising their right of withdrawal, the user can choose to be refunded (for non-sale products) or receive a credit voucher for products offered on the website www.bemaad.com. The user must communicate their choice to BE MAAD by email at the following address: contact@bemaad.com.
Refund: BE MAAD undertakes to refund the user the full amount paid as soon as possible and at the latest within thirty (30) days following the withdrawal date. Delivery fees are not refundable in case of withdrawal. Sale products are not eligible for a refund if the user is not satisfied.
Credit Voucher:
BE MAAD undertakes to issue a credit voucher to the user for the amount paid at the time of confirming their order.
Refunds will be made using the same payment method the user used when placing the order. The options for credit vouchers and refunds are available only once. Therefore, the user cannot exchange, refund, or receive a credit voucher for a product that has already been refunded or issued as a credit voucher.
If the product subject to the credit voucher is not received by BE MAAD within 15 working days following the communication of the user's decision, BE MAAD reserves the right to cancel the new order and refund the user according to the rules applicable in case of withdrawal.
8.2. Products and Services Excluded from the Right of Withdrawal
BE MAAD reserves the right to refuse the return of any product that has been worn, is incomplete, damaged, dirty, or altered by the user.
For hygiene reasons, earrings for pierced ears cannot be returned or exchanged.
Also excluded from the right of withdrawal are sale products, private sale items, customized products or products made according to the user's specifications, and products sold in bundles/sets that are inseparable from other items.
Products from imperfect sales are not eligible for returns or refunds.
8.3. Returns
If the user wishes to return the products they have received, they must first make their request directly on the website, ensuring to specify the order number, and send it to the following postal address:

The return for a refund is at the customer's expense: 5€ will be deducted from their refund.

The returned products must be in their original packaging, complete, in perfect condition, and accompanied by the original invoice. Since the return is the user’s responsibility, it is up to them to send it by tracked and signed-for mail with a declaration of the product's value and to bear the associated costs.

8.4. Defective Products
If the product ordered (unused, unworn) by the user is defective, BE MAAD agrees to repair the product at its expense and return it to the user.
To request repair of the product, the user must inform BE MAAD's customer service as soon as possible via email at the following address: contact@bemaad.com, ensuring they provide their order number.
BE MAAD's customer service will then process the request and, if approved, will send an acknowledgment email to the user confirming whether the repair request is validated.
The user must then return the defective product in its original packaging, along with the original invoice, to the following address:

Upon receiving the defective product, BE MAAD will repair the product and return it to the user as soon as possible, or no later than thirty days after receiving the defective product.
If the product cannot be repaired, BE MAAD agrees to offer the user a credit voucher for the BE MAAD online store or a refund for the amount paid by the user for the defective product.
Worn, used, dirty, damaged, or modified products are not considered defective. Defects that are due to normal wear and tear of the jewelry are not covered. Any defects caused by the user do not engage the responsibility of BE MAAD.
BE MAAD reserves the right to refuse repair, refund, or credit for the user if the defective product returned is incomplete.
8.5. Gift Card
The gift card must be credited with a minimum amount of €50.
This card can be used multiple times until its expiration date. To do so, the recipient must contact customer service to request a new code to use the remaining credit. This credit will be valid for 12 months from the date of purchase of the gift card.
No credit can be issued for gift cards.
The recipient of the gift card is free to place an order for an amount higher than the gift card balance, by adding the additional amount.
You can include a personalized message in the "Message" section of the gift card.
The gift card is valid for 12 months from the date of purchase. This card is non-exchangeable and non-refundable. It cannot be replaced or refunded in case of loss of the code or exceeding the validity period.
Article IX – Payment
9.1. Accepted Payment Methods
Payment is due in full after the user confirms the order. It is made immediately and in full upon order confirmation.
Several payment methods are available to the user to pay for their order: by credit card or PayPal transfer.
The information required for payment by credit card or PayPal transfer will be requested from the user during the order process.
9.2. Online Payment Security
The website www.bemaad.com is equipped with an online payment security system to facilitate the encryption of the user's banking data, ensuring secure payment.
The user's credit card numbers are never shared with BE MAAD and cannot be stored or used for fraudulent purposes.
The accepted credit cards for order payments are Carte Bleue, Visa, Mastercard, and Amex.
9.3. Delays and Payment Defaults
The full payment date of the order marks the start date for order preparation.
Therefore, any partially paid order delays the delivery of the products ordered by the user, and any unpaid order prevents the delivery of the order.
BE MAAD reserves the right to cancel the preparation and delivery of any order that has not been fully or partially paid, until the user settles the amount owed.
Article X – Delivery
10.1. Delivery Terms
The products are shipped to the delivery address provided by the user when placing the order. This address also appears on the order form and payment acknowledgment.
If the user wishes to choose a specific delivery method that does not appear on the available list, they must make the request before confirming the order by contacting BE MAAD customer service via email at the following address: contact@bemaad.com.
In case of a delivery error, the user must inform BE MAAD on the day of delivery, or at the latest the next business day after delivery.
A delivery receipt may be required from the user to confirm the correct receipt of the order, the compliance, and the packaging condition of the product.
In case of product damage or partial loss, the user must make reservations on the delivery receipt, one copy of which is sent to BE MAAD; within three business days following the receipt of the order, the user must notify these reservations to the carrier by registered letter with acknowledgment of receipt, in accordance with article L.133-3 of the French Commercial Code.
10.2. Delivery Timeframes
BE MAAD commits to shipping the products ordered by the user within three days following the registration of the payment.
Thus, products ordered by the user and paid for by credit card or PayPal transfer will be shipped within two business days following the date the payment confirmation email is sent to the user.
Delivery times may vary depending on the delivery method chosen by the user. For more information, please consult our "Deliveries and Returns" page.
When placing the order, BE MAAD commits to delivering the products ordered by the user as soon as possible, at the latest within thirty business days from the sending of the payment acknowledgment email.
Additional delays may apply in the case of international deliveries or other issues related to the chosen carrier. These additional delays will not hold BE MAAD responsible; however, BE MAAD commits to informing the user of any potential delays as soon as it becomes aware of them.
10.3. Delays and Delivery Failures
If the order has not been received within the timeframes indicated in the order confirmation email, it is advised that the user directly contact BE MAAD customer service via email at the following address: contact@bemaad.com.
Delays exceeding thirty business days from the date of sending the payment acknowledgment email and not due to a force majeure event may result in the user canceling the sale.

If applicable, the user must return the received products to this same address if they have been delivered. Upon receipt of the products, BE MAAD will refund the full amount paid by the user as soon as possible, at the latest within thirty business days.
Total failure to deliver results in the automatic termination of the contract.
10.4. Delivery Costs
BE MAAD gives the user the choice of delivery method from different options. These options are available for consultation directly on the website www.bemaad.com, during the order process. The delivery fees are indicated in Euros, including all taxes.
The fees may vary depending on the selected transportation type, the characteristics of the order, and the geographical delivery area.
Deliveries and services outside French territory will be subject to the provisions of the General Tax Code related to VAT.
Orders placed on the website www.bemaad.com and delivered outside France may be subject to potential taxes and customs duties at the destination. These potential taxes and customs duties are the responsibility of the user. BE MAAD is not required to verify or inform the user about the applicable taxes and customs duties. To be informed, the user is advised to inquire with the competent authorities in their delivery country.
Article XI – Warranties
11.1. Legal Warranties
All products offered for sale on the website www.bemaad.com are covered by the commercial warranty provided by the Consumer Code under articles L217-21 to L217-24 and following; and the warranty against hidden defects provided by the Civil Code under articles 1641 and following; allowing the user to return any defective product (unused and unworn) or non-compliant product.
The warranty is valid for one year from the purchase date of the product. The warranty does not cover breakage of the jewelry or its gilding, as this depends on the usage of the product; it does cover the repair of a zircon, stone, or pendant that has fallen off due to natural wear of the jewelry and wear of the clasp.
BE MAAD commits to refunding the user for the full amount paid or exchanging the defective or non-compliant product (unused and unworn) for a product of equivalent value, within the limits of available stock.
However, the seller reserves the right to refuse any abusive or improper refund requests.
The products offered for sale by BE MAAD are guaranteed for one year from the purchase date of the product.
Shipping costs for all types of repairs are the responsibility of the customer.
Article XII – Liability
12.1. Transfer of Risk and Ownership
The transfer of ownership of the product from BE MAAD to the user occurs when the user pays the full price of the said product. Delivery times do not affect the transfer of ownership of the products.
The transfer of risks related to the product takes place as soon as the product is received by the user.
12.2. Exemption from Liability
BE MAAD's liability cannot be engaged in the event of total or partial non-performance of the contract, or poor execution of the contract due to the following causes:
- by the user
- insurmountable and unpredictable actions by a third party to the contract
- a case of force majeure or fortuitous event
The products offered for sale by BE MAAD are guaranteed to comply with French standards. Its liability cannot be engaged for non-compliance with the product legislation of the user's country outside of this territory; it is the responsibility of the user to check if the product is not prohibited for sale in their country.
The symbols, texts, and illustrations represented on BE MAAD's products are used for decorative purposes and cannot engage BE MAAD's responsibility due to their primary or altered meaning.
BE MAAD is in no case responsible for the offers and statements made by its resellers.
Article XIII – Intellectual Property
The entire website www.bemaad.com is the exclusive property of BE MAAD. All its elements are protected by French laws related to intellectual property, copyright, trademark law, and patent law.
Any reproduction or dissemination of these elements, without prior written authorization from BE MAAD, exposes offenders to legal action.
Article XIV – Protection of Personal Data
14.1. Collection and Processing of Personal Data
The collection of personal data, its use for processing orders and creating customer files, and its dissemination to third parties responsible for executing and paying orders, is subject to the consent of the concerned person and is retained.
The collection of personal data is necessary for processing orders, billing, payment, and ensuring proper delivery. This data is strictly confidential and is intended solely for BE MAAD.
The processing of this data, retained by the publisher solely for the proper administration of orders and commercial relations, is subject to a declaration with the French Data Protection Authority (CNIL). This personal data is retained for a period of three years in the absence of activity on the website www.bemaad.com.
The user has the right at any time to access, modify, rectify, and delete their personal data.

BE MAAD may send Customers information about commercial offers and products of the brand via various methods: EMAIL and SMS, subject to prior acceptance.
The Customer has the right at any time to opt-out of these commercial communications, free of charge, by clicking the "unsubscribe" link in each email or by making the request at a store, through their online account, by mail, or by replying STOP via SMS.
